The Safe Body Art Act regulates Tattoo Artists in California. This state law was enacted in 2012 to protect both clients and Tattoo Artists in the body art industry from transmitting infectious diseases through the use of needles. Suppose you want to become an established Tattoo Artist in California. In that case, you must register with the department of health in the county where you plan to work, for example, Los Angeles County or San Bernardino County. Your tattoo license application should have as attachments: a health certificate signed by a physician and a vaccination certificate. You must also include application form should include the Body Art Practitioner Annual Registration Application, Hepatitis B Vaccination documentation or a Voluntary Declination of Hepatitis B Vaccination form, and Completion certificate from an Approved Bloodborne Pathogen Exposure Control Training Course.
Every year you renew your Tattoo Artist’s license. Training to prevent bloodborne pathogens exposure also must be completed every year. In addition, tattoo Artists have to complete tattoo school and tattoo apprenticeships. A degree in an art school is optional. Operating in the tattoo industry without a valid license is prohibited; a person who works in a tattoo studio without a tattoo license or with an expired license is in charge of criminal charges.
A tattoo studio must have an infection control plan and an area to decontaminate reusable equipment. The artists that work there must have a valid license. The tattoo studio owner or manager has to keep the employees’ license numbers visible in the studio. Lined Waste Containers – lined waste containers shall be located at each tattooing area.
Sharps Containers – a sealable, rigid, and puncture-proof sharps container must be provided at each procedure area for the disposal of single-use needles, needle bars, piercing needles, and sharp objects that are capable of cutting or piercing the skin, that have been used in the performance of body art and has not been disinfected or sterilized following use. Sharps containers shall be portable if portability is necessary to ensure that the sharps waste container is within arm’s reach of the practitioner. The sharps waste container must have labels with the words “sharps waste” or with the international biohazard symbol and the word “BIOHAZARD.”
